Government Ensures DACA Changes Are Temporary

Government plans to thoroughly review Supreme Court order on DACA

The Trump administration announces new measures for DACA

The current administration of the US disagrees with the idea of offering legal residency opportunities to immigrants who cross the borders without legal documentation, including minors.

That is why the Deferred Action for Childhood Arrivals (DACA) has been at risk since President Donald Trump took office in 2017.

This is a program that offers protection against deportation (for two years) to immigrants who came to the US when they were minors. They even have the possibility to extend this permit and choose a path to obtain legal permanent residence.

The Trump government tried to eradicate this program on several occasions from the benefits offered to immigrants, but the US Supreme Court of Justice denied its request and protected almost 700,000 young people covered by DACA.

However, despite the Supreme Court verdict, the Trump administration decided to implement new restrictions for DACA.

The new DACA restrictions

On July 28, 2020, more than a month after the Supreme Court order, the Trump administration announced that it will not receive new DACA applications until further notice.

In addition to that, people who must renew the permit will be able to do it, but only for one year instead of two.

Understandably, this decision sparked a gigantic controversy in the US, primarily because the government is ignoring the order of the supreme court.

Thus, dozens of immigrant rights advocates and activists will file lawsuits against the Trump government.

Government officials respond to criticism

On Wednesday, July 29, 2020, government officials declared that these measures are temporary while a final solution regarding DACA is found.

The current administration of the US wants to extensively review the Supreme Court verdict to make appropriate decisions for this program that protects young immigrants.

In fact, one of the officials from the Department of Homeland Security (DHS) stated: “If we had a final point in place, we would have already enacted it, but we are going to seriously go through a more significant process along the lines that the Supreme Court spoke in expectation of and consider all of those factors in depth that they identified and to comply with that order”.

The main reason why the government decided to implement these changes is because the Court never talked specifically about DACA, but only stated that the Trump administration’s arguments were not strong enough to cancel this program.

Therefore, the president plans to present another request to eradicate DACA, this time with different and more structured arguments.
