Driving Licenses for Undocumented Immigrants in the US

The US has 50 states in total and 13 of them allow undocumented immigrants to have driver’s license.

What are the States and the Requirements?

The states that allow an undocumented immigrant to have a driver’s license are the following:

  • California: The law AB 60 allows undocumented immigrants, who can prove residency in California, to have the driver’s license. This license cannot be used as identification.
  • Colorado: The law SB 13-251 states that undocumented immigrants can apply for a driver’s license. They must prove that they have lived in the state for a while. For example, they can provide the tax return from the last 2 years or can be recognized with an individual Taxpayer identification number known as ITIN.
  • Connecticut: The law HB 6495 authorizes undocumented immigrants to obtain a driver’s license if they can prove residence and have never been convicted of a crime. This license cannot be used as identification.
  • Delaware: The law SB 59 authorizes undocumented immigrants to obtain a driver’s license if they prove their residence through the tax return. This license cannot be used as identification.
  • Hawaii: The law H 1007 authorizes undocumented immigrants to obtain a driver’s license if they can prove residence in the Illinois Archipelagos. Thanks to the H 1007 law, undocumented immigrants with more than one year of residence in the state can get a driver’s license. In addition, it is necessary to present the passport or consular registration to prove identity. The Illinois driving license is valid for three years.
  • Maryland: The law SB 715 authorizes undocumented immigrants to obtain a driver’s license if they pay taxes in that state or are declared dependent on a resident’s tax return. It is specified that the license cannot be used to buy weapons and cannot be used as identification.
  • Nevada: The law SB 303 authorizes undocumented immigrants to obtain a driver’s license. The license cannot be used as identification.
  • New York: This state has a law called Green Light Bill that authorizes undocumented immigrants to drive in that state. This law was effective in December 2019.
  • New Mexico: This state has one of the oldest laws that allows undocumented immigrants to obtain a driver’s license. The law HB 173 effective in 2003. The local government has tried to modify the law to restrict or even cancel the permit several times without success.
  • Utah: The law SB 227 allows driving license for undocumented immigrants. The license is valid for one year.
  • Vermont: The law S 38 states that undocumented immigrants can obtain a driver’s license. It is necessary to prove the identity first in order to apply for the license.
  • Washington: This is the oldest law that authorizes undocumented immigrants to get a driver’s license. The law HB 1444 was effective in 1993 and it has never been removed or modified.

Cities that Allow Driving License for Undocumented Immigrants

  • Washington D.C: The law B 20-275 grants a driver’s license for undocumented immigrants. In this case, it is necessary to prove residence in the city for more than six months. The license, which is valid for 8 years, does not work as identification.
