Biden announces reimplementation of ‘Remain in Mexico’ program

On Thursday, December 2, the Biden administration announced the reimplementation of the program known as ‘Remain in Mexico’ or MPP (Migrant Protection Protocols), which states that asylum seekers must remain in Mexican territory until they receive a response to their immigration cases.

This announcement comes after a Texas federal judge ordered the Biden administration to reinstate the MPP policy in mid-August. This ruling was shortly thereafter upheld by the US Supreme Court.

The MPP Policy under the Biden Administration

The Trump administration officially implemented the MPP policy in 2019. When Biden launched his political campaign for the 2020 presidential election, he promised to lift the restrictions implemented by his predecessor on the immigration system and remove arbitrary policies such as the MPP.

In fact, a couple of weeks after taking office, the Biden administration suspended new enrollments in the MPP program and subsequently, in June 2021, permanently rescinded this policy, declaring it to be inefficient, unnecessary and inhumane.

However, the Texas judge, who was appointed by former President Trump, stated that the Biden administration did not follow the regular process to remove this program and, therefore, should reimplement it.

Mexico outlines new parameters for the MPP reimplementation

The Mexican government recently expressed several humanitarian concerns regarding the reinstatement of the MPP policy and outlined a series of obligations that the US must meet in order to keep the agreement active.

Let’s look at the new parameters:

  • The MPP program must focus on single adults apprehended in border territory, who intend to apply for political asylum.
  • The US must offer the option of COVID-19 vaccination before sending asylum seekers to Mexico.
  • The US must try to process political asylum cases within 180 days to avoid leaving asylum seekers in limbo, as it happened under the Trump administration and in the midst of the global Coronavirus pandemic.

It is worth noting that, although Biden followed the judge’s order and is reimplementing the MPP, his DHS (Department of Homeland Security) issued another memo in late October, which seeks to rescind the MPP policy again, but this time following the judge’s comments.
