Biden Protects Immigrant Victims of Crime

ICE will no longer be able to detain crime victims

ICE will no longer be able to detain crime victims

On Wednesday, August 11, 2021, the Biden administration issued new guidance for ICE (Immigration and Customs Enforcement), which states that ICE agents will no longer be able to detain immigrants who have been victims of crimes, except under certain conditions and specific scenarios.

It is worth clarifying that ICE is one of the entities in charge of enforcing immigration law both at the borders and within the US. As such, it is responsible for conducting investigations and operations to detain and deport undocumented immigrants residing in the country.

Under the new guidance, ICE agents will refrain from detaining and deporting immigrant crime victims, who could become a key part in the investigation of crimes nationwide. In fact, the current director of ICE stated, “When victims have access to humanitarian protection, regardless of their immigration status, and can feel safe in coming forward, it strengthens the ability of local, state, and federal law enforcement agencies, including ICE, to detect, investigate, and prosecute crimes”.

According to the statement, it is ICE’s duty to assist all individuals who have been victims of crimes, who are in need of international protection and means to safeguard their integrity.

Biden’s intent to protect vulnerable populations

The new guidance for ICE agents is another step by the Biden administration to gradually restructure the US immigration and deportation system, which has always been its goal.

In fact, the Biden administration has always emphasized the need to protect immigrant communities that need it most in order to respect and follow the values of the country as a nation of immigrants.

Therefore, one of the main focuses of President Biden and his cabinet is to remove or rescind restrictions and policies implemented by the Trump administration between 2017 and early 2021, pave the way for comprehensive immigration reform, and expand existing immigration programs for all kinds of foreign populations.
