Biden Might Narrow ICE Arrests and Deportations

The Biden administration plans to curb arrests and deportations

Immigration law enforcement within the US

The US immigration system is quite extensive and can also be complex. By this, we refer not only to options available for foreigners to come to the country through visa programs, but also to the local detention and deportation system.

It is well known that the US is the destination of thousands of immigrants annually and, on many occasions, conditions in neighboring countries and the lack of information can lead to hundreds of people trying to cross borders without legal documentation.

In fact, irregular immigration has always been an important issue for the US administrations and there are entities in charge of immigration enforcement within the country. This is the case of ICE (Immigration and Customs Enforcement), which is a branch of the DHS (Department of Homeland Security) and, apart from protecting the borders, is in charge of conducting investigations and operations to locate, detain and deport undocumented immigrants, mainly those who have criminal records or pending legal charges.

Trump substantially increased deportations through ICE

The Trump administration gave ICE gigantic power. In fact, the former president hired more than 10,000 border officers to curb illegal immigration and deport as many undocumented immigrants as possible.

During his term, former President Trump ordered ICE to increase operations conducted within the US and expanded the scenarios in which undocumented foreigners could face deportation. Adding to that, his government narrowed options available for immigrants to request legal documentation after crossing the borders without prior authorization.

The Biden administration plans to curb arrests and deportations

According to a recent report by The Washington Post, the Biden administration plans to reduce arrests and deportations in the US, as well as disempower ICE. The new administration wants to restructure the removal system and rethink the scenarios in which entities like ICE could deport undocumented immigrants.

For instance, under the new operational plan, border agents will not be able to deport immigrants who have committed misdemeanors such as assault or driving under the influence of alcohol and/or drugs, but will instead focus on deporting immigrants who have committed or participated in felonies, which would substantially reduce deportations in the US.

The guidelines for these new parameters are not ready yet, but the current administration intends to share them, both with the American population and with border agents, during the course of this week.

These changes will undoubtedly transform the way the federal government approaches irregular immigration compared to immigration enforcement under the Trump administration.
