Biden Gives Another Chance to Asylum Cases with “Blank Spaces”

More than 60,000 asylum seekers will get a new opportunity

Biden’s effort to improve the political asylum system

It is no secret that many of former President Trump’s actions were aimed at narrowing the alternatives available to the most vulnerable immigrant communities such as asylum seekers and refugees, who are people fleeing precarious situations like persecution and in dire need of international protection.

In fact, the Trump administration made hundreds of changes to the political asylum system, which substantially hindered the process and increased eligibility requirements to be admissible to the US under the premise of political asylum.

Now that President Joe Biden is leading the White House, the outlook is quite different for asylum seekers, especially because his administration has the firm intention to improve immigration processes in general, including humanitarian programs.

As a matter of fact, the Biden administration recently unveiled a fairly extensive plan to improve the political asylum process, streamline the adjudication of these cases at the borders, and reduce the backlog of asylum claims across the US.

More than 60,000 asylum seekers will get a new opportunity

During Trump’s term, asylum claims were rejected or denied under the harshest scrutiny. For instance, between 2017 and early 2021, immigration officers could reject political asylum applications due to “blank spaces”, forcing hundreds of thousands of asylum seekers to restart their applications from scratch, increasing waiting times and the backlog of pending immigration cases.

Now, the Biden administration is reversing the damage caused by this rule and will allow more than 60,000 asylum seekers, whose applications were denied for having “blank spaces” on their forms, to resubmit their cases.

This will happen thanks to the intervention of a federal judge, who responded to a lawsuit filed in November 2020, which states that the Trump administration unfairly rejected asylum applications for “blank spaces” in relatively irrelevant information such as spouse’s name when the applicant was single or for not writing N/A in sibling’s name spaces.

Thus, the federal judge allowed Biden’s USCIS (US Citizenship and Immigration Services) to review the rejected cases under these conditions until July 2022, as long as asylum applicants whose cases were denied meet certain eligibility requirements.

After four years in which the Trump administration tried to reduce immigration levels in the US at all costs, this is undoubtedly extremely positive news for foreigner populations in general.
