Last Friday (August 13), a federal judge for the District of Texas ordered the Biden administration to reimplement the policy known as “Remain in Mexico”, officially called MPP (Migrant Protection Protocols), which was initially implemented by the Trump administration in January 2019 and which forced thousands of asylum seekers to remain in Mexican territory while awaiting a response to their immigration cases.

Under this policy, asylum seekers lived in precarious situations near Mexican borders, usually in temporary shelters or camps, without constant access to food or water and without necessary medical assistance in the midst of the global Coronavirus pandemic. Adding to that, many asylum seekers reported abuse by local gangs and also felt the impact of several natural disasters that took place in 2020.

It is no secret that President Biden does not support the immigration policies of his Republican predecessor and that is why he recently suspended and rescinded the MPP policy. However, the judge’s order reverses the Biden administration’s decision and, if officially implemented, would lead to the reinstatement of the MPP, which would put the future of hundreds of thousands of asylum seekers at risk.

Advocates state the MPP decision is inhumane

On Monday, August 16, the Biden administration appealed the judge’s decision regarding the “Remain in Mexico” program, stating that it is a policy that goes against the US’ values and does not respect the human rights of the most vulnerable immigrant communities.

Adding to that, a myriad of immigrant rights advocates, activist groups and humanitarian organizations have raised their voices following the judge’s order and declare that reinstating a policy such as the MPP sends the wrong message regarding the US’ ideals and international progress.

They openly state that the vulnerability of asylum seekers in Mexican territory is quite alarming and that their integrity is really at risk in the midst of dangerous situations.
